Who is authorized to inspect the quality of fertilizer products and goods?
According to the provisions of Decision No. 50/2006/QD-TTg dated March 7, 2006, issued by the Prime Minister on the promulgation of the List of products and goods subject to quality inspection, the technical organizations designated to conduct quality inspection of fertilizer products and goods include: the Institute of Soil Science and Agricultural Chemistry; the Southern Institute of Agricultural Science and Technology; Technical Centers for Standards, Metrology and Quality Control No. 1, No. 2, and No. 3 (under the General Department of Standards, Metrology and Quality); FCC Inspection and Disinfection Company; and other technical organizations that continue to be designated in accordance with the provisions of the law.
Article 3 of this Decision also states:
“The Ministry of Science and Technology shall take the lead, in coordination with specialized line ministries, in promptly implementing Article 26 of Decree No. 179/2004/ND-CP on state management of product and goods quality, in order to continue designating and submitting to the Prime Minister a supplementary list of technical organizations that fully meet the conditions to participate in quality inspection activities.”
Based on the Ordinance on Product Quality (1999), Decree No. 179/2004/ND-CP, the aforementioned Decision No. 50/2006/QD-TTg, and Circular No. 02/2006/TT-BKHCN dated January 10, 2006 of the Ministry of Science and Technology guiding the conditions and procedures for designating organizations to conduct quality inspection of products and goods, on March 19, 2007, the Ministry of Agriculture and Rural Development issued Decision No. 710/QD-BNN-TT on the recognition of organizations authorized to conduct quality inspection of fertilizer products and goods, namely Vinacontrol Inspection Joint Stock Company and the Lao Cai Sub-department of Standards, Metrology and Quality.
Accordingly, under the regulations, the list of technical organizations recognized under Decision No. 710/QD-BNN-TT must be submitted to the Prime Minister for supplementation into Decision No. 50/2006/QD-TTg. However, it is unclear whether the relevant specialized ministry has carried out this procedure. Nevertheless, Vinacontrol Inspection Joint Stock Company has issued notifications to the General Department of Customs and provincial and municipal Customs Departments, requesting facilitation and support.
